If you have chosen to make your profile and information publicly available, you understand that the content you post may be viewed, downloaded, or shared with visitors and third parties in connection with your use of the Services and that we cannot and do not control any such third parties. You may change the visibility of some content by going to your Profile Settings when you are logged in.

You are solely responsible for any loss or damage you or we may suffer due to your failure to do so. If you know or suspect another person may have access to or use your account or registration details, you must notify us promptly. You agree to notify us immediately of unauthorized use of your account, username, or password. CareOurEarth shall not be liable for any loss you incur due to someone else using your password or account, either with or without your knowledge.

You are responsible for everything done using your registration details. You acknowledge that we may suspend, terminate, or prevent your account and/or access to this Website at our sole discretion. Where we suspend, terminate, or prevent your registration, you must not attempt to re-register or submit any content, material, or applications without our prior written consent. By posting your Content, you grant CareOurEarth a perpetual, nonexclusive, worldwide, royalty-free, sub-licensable license to the content, which includes without limitation the right for CareOurEarth or any third party it designates, to publish, use, copy, reproduce, translate, display, store and distribute your Content (in whole or part) and/or to incorporate it in other works in any form, format, media, or technology later developed (including without limitation in print, digital and electronic form) throughout the world by the provisions of these Terms. Currently, all posts submitted to CareOurEarth must be written in English; posts written in other languages are not acceptable for now. CareOurEarth shall not be a contracting party to any agreements entered into by Users with other Users or any third party via the Services. Users are solely responsible for the execution and fulfillment of contracts they enter into. CareOurEarth shall not be held liable for breaches of duty about such agreements.

4. Sponsor Content

“Sponsor Content” consists of: (1) all paid-for content created by the CareOurEarth custom content journalists in collaboration with sponsors or advertisers and served by or appears in any CareOurEarth medium and (2) paid-for content supplied by advertisers that is served by or appears in any CareOurEarth medium. These categories encompass any paid-for content purchased under the 4A’s/IAB Standard Terms and Conditions for Internet Advertising Version 3.0.

To ensure clarity and trust, all sponsor content must meet our editorial standards and adhere to the following guidelines:

All sponsored content will be marked as “Sponsored” or “Paid Partnership” to differentiate it from editorial content.
All promotional affiliations or paid partnerships will be explicitly disclosed at the beginning of the content, in full compliance with the Federal Trade Commission (FTC) regulations.

CareOurEarth has not reviewed, and cannot review or control, all of the information or content, including computer software or other goods or services, made available on or through third-party websites. Accordingly, CareOurEarth does not represent, warrant, or endorse any third-party website or the accuracy, currency, fitness, lawfulness, or quality of the information, material, goods, or services available through third-party websites. CareOurEarth disclaims all responsibility and liability for any damages or other harm, whether to you or third parties, resulting from your use of third-party websites. Under any of the following events without limitation, CareOurEarth is entitled to immediate extraordinary termination at any time: (1) you breach a contractual obligation of these Terms; (2) you fail to comply with any applicable legal provisions; (3) you promote any communities or associations or any other activities, which are under surveillance by authorities responsible for public safety or the protection of minors; (4) you expose CareOurEarth to potential risk or legal liability; and (5) the reputation of the Services is potentially substantially impaired by your presence or registration.

Any termination of this Agreement automatically terminates all rights to use the Website and Services. Upon termination, you shall cease any use of the Website and Services. After termination, CareOurEarth reserves the right to exercise whatever means it deems necessary to prevent your unauthorized use of the Website and Services.

CareOurEarth reserves the right to modify or change these Terms by amending this page or posting a new version at any time upon notice to you or a change notice on the website. You are obliged to check this page occasionally to take notice of any changes we make, as they are binding on you. You are deemed to have accepted the new terms when you continue to use the Services after that. Modifications that only have a minor impact on the functionality of the Services are not considered changes to the Services or changes to these Terms as described above. This applies, in particular, to a change of layout and placement of features.

12. Applicable Law and Dispute Resolution

We do not represent that the information and content in the Services are appropriate or available for use in any particular location. Those who choose to access or use the Services do so on their initiative and are responsible for compliance with all applicable local laws, including if you are in the United States, any applicable export control, or foreign assets control regulations.
The laws govern these Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed by the laws of Hong Kong. If you are in the European Union, these terms shall be governed by the laws of England.
If you are in the USA or Canada, these Terms shall be governed by the laws of the State of New York, without regard to any conflict of law provisions, and the parties agree to submit to the exclusive jurisdiction of the courts in the State of New York.
For our exclusive benefit and to the extent possible in the applicable jurisdiction, we retain the right to bring or enforce proceedings as to the substance of the matter in the courts of the country of your residence or where these Terms are entered into in the course of your trade or profession, the country of the place of business in which you agreed to these Terms or (if different) the country of your principal place of business.
In the event of any legal action arising from or relating to these Terms of Use or your use of any Service, you waive the right to a jury trial at this moment.
You represent and agree that any arbitration shall be limited to each Claim individually and that each may only bring claims against the other in capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Should any part of this Agreement be declared invalid, void, or unenforceable by a Court of Competent Jurisdiction, such decision shall not affect the validity of any remaining portion hereof, which shall remain in full force and effect.
